MARSHFIELD — Earlier this year, the U.S. District Court for the District of Columbia struck down the rule that allows small businesses to pool together to access affordable, high-quality health insurance through Association Health Plans (AHPs). In early May, The Wisconsin Office of the Commissioner of Insurance released a statement noting that “unless this ruling is overturned or stayed, association health plans are now subject to the Department of Labor rules and guidance that were issued prior to the AHP Rule. OCI cannot provide guidance as to whether a particular association meets the Department of Labor pre-AHP Rule requirements”.
These two actions are currently preventing the Marshfield Area Chamber of Commerce & Industry from working with Security Health Plan in the development of an Association Health Plan. The Department of Labor and the U.S. Chamber of Commerce have taken action to have the court ruling overturned.
While this action works through the legal system, MACCI continues to work with Security Health Plan on two strategies. One strategy prepares for the advent that the court ruling is overturned and MACCI will be able to offer an Association Health Plan. The second strategy is based upon the continuation of the current status, preventing the development of an AHP. The goal is to work with SHP to offer more affordable small business insurance plans and other cost savings options to membership. MACCI hopes to offer new health coverage for membership by late 2019, early 2020.
